Workers Compensation Insurance in Nebraska (NE)

Small Business Coverage and Peace of Mind

Nebraska has long been known for its grain and beef production. And thanks to its central location in the United States, Nebraska is an important nexus for national infrastructure – from the age of locomotives to today’s production of national wireless and high-speed data networks. In addition, Nebraska entrepreneurs are helping the state’s economy grow and diversify. Private health care, data processing companies, law firms and repair shops are among the leading income producers in Nebraska’s services industries.1

What are the Nebraska Workers’ Compensation Insurance Requirements?

In Nebraska, all employers are required to carry workers’ compensation insurance, regardless of whether they are full-time, part-time, in private or public industry, minor, or employees of charitable organizations. There are a few exceptions: household domestic workers and some agricultural employees are not covered unless their employer chooses to seek insurance. Sole proprietors, partnerships, and LLCs are also exempt from coverage. Executive officers of Nebraska corporations who own 25% or more of the corporation’s stock are not considered employees and are exempt from coverage unless they elect to be covered. Executive officers of Nebraska non-profit corporations who receive $1000 or less from the corporation are also exempt from coverage unless they elect to be included.2

The penalties for failing to provide workers’ compensation insurance could include civil fines up to $1000 for each violation, and each day with failure to secure coverage is a separate violation. Penalties could also include imprisonment for up to a year, or an enjoinder from doing business in Nebraska until workers’ compensation insurance is obtained.3
